These Terms and Conditions govern access to and use of Unblinded, a B2B healthcare analytics software platform and related services operated by Unblinded.
Unblinded is a product operated under the trade name Unblinded by Meenakshee Ratha. References in these Terms to "we", "us", "our", or "Platform Owner" mean Unblinded. References to "Platform" mean the Unblinded website, software products, analytics dashboards, reports, subscriptions, data tools, project-based services, and related services.
By accessing, browsing, registering on, purchasing from, or otherwise using the Platform, you agree to be bound by these Terms, our Privacy Policy, Refund and Cancellation Policy, and any other applicable policy posted on the Platform. If you do not agree, do not use the Platform.
The Platform is intended for businesses, organisations, healthcare professionals, hospitals, pharmaceutical companies, insurers, research teams, healthcare operators, and other professional users. It is not intended for emergency medical use, direct patient care, or use as a substitute for professional judgement.
- You agree to provide true, accurate, current, and complete information during registration, purchase, onboarding, and use of the Platform, and to keep such information updated where applicable.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.
- The Platform offers B2B software access, analytics dashboards, data organisation tools, reports, workflow tools, subscriptions, consulting support, implementation services, and project-based analytics services. Access may be limited by plan type, organisation, user seat, feature, module, project scope, subscription duration, or other restrictions specified on the Platform or in a written agreement.
- Paid access, subscriptions, project fees, implementation fees, and analytics services are subject to the pricing, billing, renewal, cancellation, and access details displayed at the time of purchase or agreed separately in writing.
- Unless expressly stated otherwise, purchase of one plan, subscription, dashboard, report, module, project, or service does not entitle you to any other plan, subscription, dashboard, report, module, project, or service.
- You agree to pay all charges associated with your purchase. All payments are subject to our Refund and Cancellation Policy.
- If you submit, upload, connect, or otherwise provide data to the Platform, you represent and warrant that you have all required rights, permissions, notices, consents, contracts, and legal bases to provide such data to us and to allow us to process it for the agreed purpose.
- You shall not upload or provide data that you are not legally authorised to share. You are responsible for removing, masking, anonymising, de-identifying, or limiting personal, patient, clinical, confidential, or regulated data where required by law, contract, institutional policy, or professional obligation.
- You are responsible for the accuracy, quality, legality, completeness, and reliability of the data, assumptions, instructions, and inputs you provide to the Platform. Outputs generated by the Platform depend on the quality and scope of the inputs provided.
- Analytics outputs, dashboards, reports, models, benchmarks, recommendations, or summaries generated through the Platform are provided for informational, operational, research, business, or decision-support purposes only. They are not medical advice, clinical advice, legal advice, insurance advice, financial advice, prescribing advice, diagnostic advice, or a substitute for qualified professional judgement.
- You shall not rely on the Platform as the sole basis for clinical decisions, prescribing decisions, diagnosis, treatment, patient management, insurance coverage decisions, regulatory submissions, or other high-risk decisions without independent professional review and validation.
- You shall not use the Platform for unlawful surveillance, unlawful profiling, discrimination, unauthorised patient identification, unauthorised re-identification of anonymised or de-identified data, or any activity that violates applicable law, contract, institutional policy, or third-party rights.
- You shall not share accounts in an unauthorised manner, resell access, redistribute paid reports or dashboards, copy substantial parts of the Platform, scrape the Platform, attempt to reverse engineer the Platform, interfere with security, introduce malicious code, bypass access controls, or use the Platform in a way that is unlawful, abusive, fraudulent, or harmful.
- The Platform and its content, including text, graphics, branding, layout, software, dashboards, reports, analytics structures, workflows, documentation, models, and other materials, are proprietary to us or licensed to us and are protected by applicable intellectual property laws.
- Subject to these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Platform for your internal business or professional purposes. No ownership rights are transferred to you.
- You retain ownership of customer data that you lawfully submit to the Platform. We may process such data to provide the Platform, deliver contracted services, maintain security, improve functionality, troubleshoot issues, and comply with legal obligations. Use of customer data is also governed by our Privacy Policy and any separate written agreement, if applicable.
- We may generate aggregated, anonymised, statistical, or de-identified information from Platform usage or datasets processed through the Platform, provided such information does not reasonably identify an individual or customer in breach of applicable law or contract. Such information may be used to improve the Platform, create benchmarks, develop analytics models, and prepare market or operational insights.
- We do not guarantee uninterrupted availability of the Platform or that the Platform will always be error-free, secure, compatible with every system, or suitable for every customer use case.
- We do not guarantee any specific business outcome, financial result, clinical outcome, regulatory outcome, operational improvement, insurance outcome, research finding, or commercial result from use of the Platform.
- We may suspend, restrict, or terminate access to the Platform at our discretion in cases including breach of these Terms, fraud, payment failure, chargeback abuse, misuse of data, misuse of content, security concerns, legal necessity, or reputational risk.
- We may modify, discontinue, update, or remove any feature, content, dashboard, report format, price, plan, or part of the Platform at any time, with or without notice, subject to applicable law and any separate written agreement.
- The Platform may contain links to third-party websites or services, or may integrate with third-party tools. Your use of such third-party services is governed by their own terms and policies, and we are not responsible for them.
- To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including warranties relating to availability, accuracy, completeness, fitness for a particular purpose, non-infringement, medical correctness, regulatory suitability, and commercial usefulness.
- To the fullest extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, business opportunity, clinical consequences, regulatory consequences, or third-party claims arising from use of or inability to use the Platform.
- You agree to indemnify and hold harmless the Platform Owner, its affiliates, service providers, officers, representatives, contractors, and employees against claims, losses, liabilities, costs, and expenses arising out of your breach of these Terms, misuse of the Platform, unlawful data sharing, violation of law, violation of third-party rights, or reliance on Platform outputs without appropriate independent review.
- We may revise these Terms from time to time. Updated Terms will become effective upon posting unless otherwise stated. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
- These Terms shall be governed by and construed in accordance with the laws of India.
- Any dispute arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
